mailing lists, double opt in and all that crap

any one got any info on the legalities involved in the above? I'm after actual legal requirements and issues rather than someones take on it (which is all i seem to be able to find)

Don't know but apparently as of yesterday any company found spamming can be fined up to £5000 *Gulp*

I was reading an article yesterday on the BBC I think which said something along the lines of unsolicited spam can be sent to companies, but must have an opt-out clause inside it. Spam to consumers is banned.

From the research I've done on it in the past, a true double opt in needs to stamp a unique sode on the first request (for example via a web form) the email that is returned to the user must be stamped with this code and so must their return e-mail confirming the opt in...

Lot of work. I'll try to dig out the info that I found over the weekend

How did it go? I looked for my research but I seem to have lost it - or it got deleted

I've been looking back into stuff but am having real trouble finding the actual regulations. I have the EU Directive but remain unsure exactly which UK one implements this...

I've come up with around 3 + their comencement directives which all appear to address the issue. But I can find no info that will actually tell me what is what. The damn dti, IC, OFTEL etc sites are no bloomin help either... I think I know what the regs involve now, but I need hard proof for the boss.

+ I've not been able to findany details in regards to the state of current lists?

Opt-in by email is all well and good - you've got proof via headers and dates etc (unless you found out more) but what about a phonecall followup on an obtained email to confirm opt-in?

Which is the state of many of the lists we have...

+ do the self-employed count as buisness or indivduals (I'm thinking it's the latter from what I've said so far)

Yeah the directives etc mention nothing about stamping codes etc as far as I can see... I think it was just an overly cautious approach by someone. Probably worth looking into though if it is needed?
