excuse me? everything on my site is created by me.. the problem i have with your picture is that it is using someone elses work, and that is known as ripping

unless you have received permission from the person who originally created it to use the image you are violating copyright laws

I'm not going to hate on you, I'll say it, you can make some good vector images, and I don't like messing with vectors, so you're obviously better than me, but stick to logos.

NOW FOR MY SPEECH:

I'm not saying that your site wasn't created by you, I'm just saying that it's all cliche, and shitty. Don't try and pull this "law" crap on me, because for your information, I can take an image and edit it for the purposes of a joke. How do you think SNL and Mad TV get away with recreating shows for the purpose of criticism?? THey let the show keep it's name and everything, they just have other actors impersonate the actual cast. And believe me, the actual show's producers usually don't support them slandering their series. Or Wierd Al Yankovic, he takes songs by everybody and twists them up for humor and criticism, and people TRY to take him to court, but usually don't have much on him because it is LEGAL. Don't call me a ripper either, I'm not one. I am an actual designer... I can't say as much for you though... Your site is tacky, it looks like you took the buttons that say LOGO DESIGN and WEB DESIGN straight from Mac or a Monster Template! You think that since you can piece a few photoshop layers together, add a layer style and read a few tutorials, that it makes you a designer? Bleh... jokes on you. Listen, I could recreate your entire site in less than an hour. And that blue color scheme has gotten REALLY OLD, REALLY FAST! Listen, come back to me when you can create something of skill without using a friggin filter. I mean come on... that little site that you want reviewed, is the same color as something my grandfather produces... with his arse.

There was also a problem with some hot sauce company in Louisiana that Tanya Harding (I think it was her, that violent, crazy little figure skater) tried to take to court because they had a picture of her on it, and the slogan was

Or something to that jist. But the skater had no case because it is LEGAL. Stop trying to bother me. I have been behaving lately on this board, not starting stuff with people and such, so please, I don't want to get banned for setting you straight.

you're entitled to your opinion on my work, but thats not the issue here

just because you're trying to be humourous that doesnt change the fact that you're using someone elses work without their permission

the examples you use arent valid. Wierd Al Yankovic for example, he sings the songs, theres nothing illegal about singing someone elses, it would be illegal if he took the original song and used it without paying copyright fees/getting permission

now, if you had recreated that image of homer, then it wouldnt be an issue as you created it.. you could then only be accused of being inspired by the original picture, but theres nothing illegal about that

as for setting me straight, i know for a fact that what im saying is correct

Okay, so Wierd Al sings his own lyrics, with someone elses Instrumentals. I draw my own version of homers head, with someone elses skull of homer.. hmmm we both use the same MAJOR part of the piece, and we both edit the key to part of it to fit our own needs. Hm... I wonder, the way I see it, the only difference is the medium.

The art in this work is not in the creation of a unique image from scratch, but in the creative manipulation of an existing one.

Any way you look at it, the bottom line is that it is art... moreso than some ORIGINAL works I've seen (e.g. stealthcow's homepage).

By your arguement, stealthcow, manipulation of a photo by someone else would also be a rip (note other entries in this and previous contests)... a photograph of a ladybug would be a rip of Mother Nature.... a sculpture that uses pieces of a car is a rip of Ford Motor Company!!!

The truth is, the concept and final product are all that count in artwork. Anyone who says differently puts his credibility on the line.
