Well in fact it did stop and the investment bank that stepped in at the wrong moment is to today still paying 100's of millions in legal settlements (latest 100 million settlement a few months back).
And napster was small fry comparing to the 100's of thousands of videos added to youtube every day. If one of the lawsuits against google goes through everyone will jump aboard and it will be hell. Even google can't just throw that kind of money around.
